The purpose of this Guidance is to provide useful information to inspectors on how to conduct thorough and nationally consistent agricultural inspections under EPA’s Worker Protection Standard (WPS) that are also in conformance with Title VI of the Civil Rights Act and the Rehabilitation Act.
This Guidance highlights the focus areas for agricultural WPS inspections and provides useful information to inspectors, as well as lead agencies, about how to involve individuals with limited English proficiency (LEP) or disabilities in the inspection process.
This WPS Agricultural Inspection Guidance supersedes the EPA WPS Inspection Guidance released in April 2004. This Guidance represents EPA’s recommended procedures and content for conducting complete FIFRA WPS agricultural inspections. It provides the minimal criteria of coverage for all future routine and for-cause WPS agricultural inspections conducted by EPA, state, territorial and tribal pesticide regulatory agencies. Deviations from this Guidance on the part of any duly authorized official, inspector, or agent shall not be a defense in any enforcement action; nor shall deviation from this Guidance constitute grounds for rendering the evidence obtained thereby inadmissible in a court of law.
