Woman suing judge took nude cell phone pics

HEIGHTS — A Muslim woman who is suing a Wayne County judge for making her remove a religious scarf during a court proceeding says that several cell phones containing nude photos of her were stolen during a burglary at her house.

Raneen Albaghdady, 33, called police March 27 after she found her house in the 25000 block of Andover ransacked. Among the items taken were six cell phones that she told police had nude photos on them.

She said she suspected an ex-boyfriend was responsible for the break-in, and that she was worried he may post the photos on the Internet, because he previously had posted other pictures of her online, police said.

The incident could come into play as her lawsuit against 3rd Circuit Court Family Division Judge William Callahan moves forward.

Filed in the U.S. District Court for the Eastern District of Michigan in August, the suit alleges that Callahan denied Albaghdady’s religious freedom when he made her remove her hijab during a June name change hearing in his Detroit courtroom.

A hijab is an Islamic headdress worn by Muslim women that covers various parts of the head, neck, and face, according to the complaint.

At a press conference announcing the lawsuit held by the Council of American Islamic Relations Michigan chapter, a Muslim civil rights organization and co-plaintiff on the suit, a spokeswoman for the group described the significance of the hijab.

“It’s out of sheer modesty of appearance and dress and covering your beauty,” she said. “When one is accustomed to wearing the hijab, to a certain way of dress, to a certain way of acting, to have to then uncover, you almost feel revealed or definitely very vulnerable, but understandably so, humiliated and embarrassed.”

Callahan has maintained that he didn’t know the hijab was a religious garment. A courtroom video of the exchange between Callahan and Albaghdady went as follows:

Callahan: “The headpiece…,” while gesturing to remove the piece.

Albaghdady: “I’m sorry?”

Callahan: “No hats allowed in the courtroom.”

Man seated in courtroom: “It’s not a hat. It’s a scarf.”

Callahan: “Excuse me, sir.”

Albaghdady: “This one?” pointing at her hijab.

Callahan: “No hats allowed in the courtroom.”

Albaghdady: “This one?”

Callahan: “Yes.”

Albaghdady: “OK. It doesn’t matter.”

She then removed the piece.

The case currently is under consideration for dismissal or summary judgment by presiding Judge Marianne Battani. The motion was filed by the Michigan Attorney General’s Office, which is representing Callahan, and seeks to have the suit thrown out on judicial immunity guidelines.

Assistant Attorney General Margaret Nelson on Thursday said the motion centers on the legal basis of Albaghdady’s claim, not the factual basis. But she said the cell phone photos could prove germane if the motion is denied. “If we lose this motion then the next step would be to develop the facts,” she said. “And that’s certainly something that we would look to develop at the time.”

Canton Township attorney Nabih Ayad, who is representing Albaghdady, said that the photos would have no bearing if the case goes to trial. A telephone call to Albaghdady seeking comment for this story was not returned as of press time.

“People convert to religions all the time, so the fact that she may have taken some photos for her husband sometime in the past is of no significance to this case,” he said.

(IsraelNN.com) The head of the human rights group Amnesty International, Claudio Cordon, issued a letter supporting "defensive jihad" – a term which is used to support ideological terrorism around the world.

Three weeks ago senior Amnesty worker, Gita Chagall, expressed opposition to the fact that the organization was holding contacts with Muazam Bag, who is identified ideologically with the Taliban. The same day Chagall was suspended from her job, after 30 years of work for Amnesty.

While other human rights activists protested Chagall’s dismissal, Amnesty’s Secretary-General himself, defended the relationship between Amnesty and the Taliban follower, claiming that "defensive jihad isn’t against human rights."

Amnesty International has frequently accused Israel of human rights abuses.

More Americans Give Up Citizenship As IRS Gets Aggressive Overseas

The number of American citizens and green-card holders severing their ties with the U.S. soared in the latter part of 2009, amid looming U.S. tax increases and a more aggressive posture by the Internal Revenue Service towards Americans living overseas.

According to public records, just over 500 people worldwide renounced U.S. citizenship or permanent residency in the fourth quarter of 2009, the most recent period for which data are available. That is more people than have cut ties with the U.S. during all of 2007, and more than double the total expatriations in 2008.

An Ohio-born entrepreneur, now based in Switzerland, told Dow Jones he is considering turning in his U.S. passport. Mounting U.S. tax and reporting requirements are making potential business partners hesitate to do business with him, he said.

"I still do dearly love the U.S., and renouncing my citizenship is not something I take lightly. But more and more it is seeming like being part of a dysfunctional family," said the businessman, who asked that his name not be used for fear of retribution.

"The tax itself is only a small part of the issue," the Swiss-based entrepreneur said. "It's the overall regulatory environment."

A minority of the recent expatriates are U.S. natives who have started a new life overseas. Most are people with family ties outside the U.S.: foreign professionals who acquired a green card while working in the U.S., or people who have received higher education in the U.S.

"Fifteen or 20 years ago there was a big rush to make sure your kids became U.S. citizens, for access to U.S. schools for example," said Timothy Burns, a tax lawyer at Withers law firm in Hong Kong. "Now we're seeing just the opposite."

Last month, the Treasury Department announced more rigorous requirements for Americans living abroad to report information on foreign bank accounts. The reporting requirement has been in place for years, but only in the most recent couple of years has the IRS gotten tough about enforcing penalties.

The information return must be filed by any U.S. citizen or resident whose balance in all foreign accounts combined exceeds $10,000 at any time during the year. Stiff penalties, up to 50% of the annual account balance, punish failure to file.

Others are giving up their U.S. nationality to avoid tax hikes in the U.S., as the government struggles under huge budget deficits. The top marginal tax rate is set to rise to 39.6% from 35% at the end of this year. A proposal to tax fund manager pay at ordinary income rates, instead of the 15% capital gains rate, is gaining currency in Congress.

"Everybody sees the tax rates are going up. At a certain point, it gets beyond people's pain threshold," said Anthony Tong, a tax partner at accounting firm PricewaterhouseCoopers in Hong Kong.

Unlike most jurisdictions, the U.S. taxes the income of citizens and green- card holders no matter where in the world it is earned.

In order to give up U.S. citizenship, a person must obtain or have citizenship in another country. The person surrenders their passport or green card during an interview with a consular officer in their new home country. He or she must also submit a form, including a list of assets, to the IRS to complete the process.

Chris Kavanagh of the American Institute in Taiwan, which represents U.S. interests in Taiwan, said 43 people gave up their U.S. citizenship in Taiwan in 2009, the highest that figure has been since 2003. He cautioned against drawing conclusions from that data, however.

The IRS says some of the swelling of numbers of expatriations towards the end of 2009 occurred because the agency made a push to notify people that had already surrendered their passport, but had not completed the process by submitting the IRS form. Until that form is received by the IRS, these people are still subject to U.S. tax. "There is some catch-up going on," said IRS spokesman Bruce Friedland.

The stock market plunge of late 2008 and early 2009 may also have played a role in the spike in expatriations. Since 2008, Americans with net worth greater than $2 million have had to pay an exit tax assessed on their assets. With gains reduced or wiped out by the market collapse, those seeking to give up their U.S. citizenship had an opportunity to do so with less exit tax required.

Most Westerners, myself included, know little about Albania. Over the last few years I’ve picked up a few tidbits of knowledge, but Albania is still largely terra incognita for me.

When I posted the Albanian translation of Geert Wilders’ speech the other day, I mentioned that many Albanians who are officially Muslims consider themselves Christians, and that the tradition has been passed down secretly within the families for centuries, but I didn’t realize how extensive this phenomenon was. Our Albanian translator, Ilia Toli Ph.D., has left a comment on the post giving more details:

I’m a Christian Orthodox Albanian. Now there’s a census in Albania and the religion will be one of the check-boxes. The biggest opposition to this are the Muslim authorities. They know that people by the millions will declare themselves Christians if given a chance, and that they’ll not be able to brag as they do now that Albania is 70% Muslim. Intermarriages are rampant and children declare themselves Christians. A strong motivation to do so is the fact that Turkey is the pariah of Europe. At every major terroristic event, Albanian Muslims denounce their faith by the hundreds of the thousands. In the northern, mountainous, sparsely inhabited part of the country there are still some oases of fanaticism.

There have been for centuries some Jews of Muslim outlook in Albania. They’re heirs to Shabetai Zevi and live in the countryside of Berat. By now they have no interest on Israel and Israel has no interest on them. They regard themselves just like another Muslim tribe. They’re called Donmeh.

There are a colorful variety of traditions among Albanian Muslims that point to their Christian non-distant past. For example, many have two names, one Christian at home and one Muslim in public. The point is that these all have been very diluted with time. There’s no special designation for these people.

There’s a great divide between Albanian Muslims of Albania and of the other neighboring countries. All terrorist groups caught in USA were from the latter. They’re more arrogant and assertive.

Sometimes Albanian Christians are even more assertively anti-Serbian, if not at a rhetorical level, because we’re suspicious patriots. By the way, personally I am not a patriot at all, I’m pro-Serbian.

These are the optimistic notes. On the pessimistic side, I don’t want Albania to be template for the future France. Islam is leaving Albania but not the Muslim ways. They’ll be around for the centuries to come. That can be easily noticed on what Albanians reproach themselves. Just an example. Albanians do not ask God to “please give me a horse”, they ask him to “please make the horse of my neighbor die.”

Among friends we try to totally avoid the topic of religion, and if it unfortunately happens, we all recite in chorus “but we’re grown up without religion.”

If you are unhappy with the Republican National Committee and still wish to find a way to support Republican candidates,there is a new organization to which you might contribute: American Crossroads. Like New Ledger's Pejman Yousefzadeh, I supported Michael Steele's candidacy for head of the RNC and now regret it as he has consistently failed to meet my expectations. If the Republicans are to take back the federal government it must be by proving their willingness to be fiscally responsible and the wasteful spending of the RNC under Steele is no way to send that message.

The Washington Examiner, citing Brody Mullins, describes the organizers of American Crossroads:

The new American Crossroads organization will be run by former RNC Chairman Mike Duncan and Joanne Davidson, a onetime RNC co-chair. Former RNC Chairman Ed Gillespie and former White House adviser Karl Rove are informally advising the organization.The day-to-day operations will be handled by Steven Law, who is leaving a top role at the U.S. Chamber of Commerce. Republican consultant Jim Dyke will also be involved.

Peter Stone at the National Journal has even more details on the group:

So far, the new soft-money group, American Crossroads, has received commitments of almost $30 million and is seeking to raise a total of some $60 million to help dozens of Senate and House incumbents and challengers this fall, say three sources familiar with the new 527. In contrast, at the start of January, the Republican National Committee had only $8.4 million in the bank compared with the $22.8 million it had on had a year earlier when Steele was elected chairman.Steven J. Law, the general counsel at the U.S. Chamber of Commerce and one time executive director of the National Republican Senatorial Committee, is expected late next week to take over as president and chief executive officer of the 527. American Crossroads is now assembling a board of directors that's likely to include some big donors and a few GOP luminaries.

Western Legacy Alliance Supports Overhaul of the EAJA Act

If they were victorious in court, the government would have to pay their legal fees. It leveled the playing field so that Citizen David could stand up and defend himself against Big Government Goliath.

EAJA abuse is just the tip of the iceberg as these radical environmental groups have tapped other sources of taxpayer dollars that were never meant for that purpose to fund their agenda. As Congress begins the process of following the money trail of EAJA abuse, we urge them to continue uncovering other ways that the taxpayer’s hard earned dollars are being used to advance a particular political agenda and support the ever growing cottage industry of environmental lawyers and the special interests that profit from this abuse.

With soaring deficits, Congress needs to ensure that every taxpayer dollar is spent wisely. H.R.4717 should be the first of many steps in that direction. Representatives
Lummis, Herseth Sandlin and Bishop should be commended for their groundbreaking efforts and we urge all Members of Congress to sign on as co-sponsors to this important legislation.
Stop your tax dollars from being spent on behalf of self-serving organizations that bite the hands that feed them. Call or write or email your congressman today.

Let us theorize for a moment: what if a state revives a state militia, for the sole and expressed purposes of defending that state against foreign and domestic tyranny and usurpations, as expressed in the second amendment? What if three-fourths of the states deny this state the right of protecting its freedom, independence and sovereignty through a well-regulated militia? What if the federal government attempts to shut the militia operation down and criminally prosecutes those participating?

As I have repeatedly stated, the States in America are choosing (and will be forced to choose) which path they are going to take: the road to freedom or tyranny? Some will choose the path of truth and freedom. Others will choose the path of manipulation, lies and slavery. And so the principles of limited government may be able to thrive once again in those states that choose freedom.
No, it's not about some supposedly well-armed "crackpot" group being targeted by the media. It is all about the sovereignty of your State, and it has as much to do with the Tenth Amendment as the Second.

Last October, right around the time that Lisa Pack went back to work at reduced hours, Birmingham's mayor was convicted of fraud and money-laundering for taking bribes funneled to him by Wall Street bankers — everything from Rolex watches to Ferragamo suits to cash.
