EPA Policy on Consultation and Coordination with Indian Tribes

The EPA Policy on Consultation and Coordination with Indian Tribes establishes clear EPA standards for the consultation process. It defines when and how consultation takes place, designates EPA consultation contacts to promote consistency and coordination of the process, and establishes management oversight and reporting to ensure accountability and transparency.

The Policy sets a broad standard for when EPA should consider consulting with federally recognized tribal governments based on Executive Order 13175 and the 1984 EPA Policy for the Administration of Environmental Programs on Indian Reservations.

EPA Policy on Consultation and Coordination with Indian Tribes: DRAFT Guidance for Discussing Tribal Treaty Rights - Consultation Version

Please submit comments by October 30, 2015

The U.S. Environmental Protection Agency (EPA) is initiating consultation and coordination with federally recognized tribes (tribes) on how EPA will consult on tribal treaty rights during tribal consultations under the 2011 EPA Policy for Consultation and Coordination with Indian Tribes (Consultation Policy). EPA is proposing development of a guidance on when and how EPA would raise questions about treaty rights, and as a guide for discussions when tribes raise treaty rights concerns during tribal consultation under the Consultation Policy. The consultation and coordination process is being conducted in accordance with the EPA Policy on Consultation and Coordination with Indian Tribes.

We share this draft guidance with you because we want your feedback on how to make it as effective as possible. EPA would appreciate input on the following questions, and any additional information you would like to provide about the draft guidance:

EPA's American Indian Environmental Office invite you and your designated consultation representative(s) to participate in this process. EPA will host a series of national calls to support your participation in this consultation process.

  1. Does the draft guidance further EPA’s goal of learning about treaty rights that exist in areas that may be impacted by the proposed EPA action or decision?
  2. Do the questions posed in the draft guidance adequately define the scope and range of questions EPA should ask?
