Dear Select County and District Superintendents:

NOTIFICATION OF OPEN ENROLLMENT SCHOOL STATUS

The purpose of this letter is to inform you that pursuant to the Open Enrollment Act (Senate Bill X5 4) one or more schools in your district is on the list of 1,000 low-achieving schools, also known as “Open Enrollment” schools.

Upon this notification, Open Enrollment schools must notify the parents, guardians and caregivers of all students enrolled of their option to transfer. You can find information including the list of 1,000 Open Enrollment schools, Frequently Asked Questions, an overview of the methodology for determining the 1,000 Open Enrollment schools and other resources on the CDE Open Enrollment Web page at http://www.cde.ca.gov/sp/eo/op/. This list contains information current as of July 30, 2010. Please note that school information may have changed since July 30, and there may be schools on the list that are no longer enrolling students.

The Open Enrollment Act was signed into law on January 7, 2010, and became effective on April 14, 2010. The Open Enrollment Act provides students enrolled in one of the 1,000 Open Enrollment schools the option to enroll in a school within the same district or any other district, provided the school to which they are applying has a higher Academic Performance Index (API) score than the pupil’s school of residence. An overview of the methodology used to identify Open Enrollment schools is available on the CDE Open Enrollment Web page.

To ensure that parents with children in any of the 1,000 schools have the opportunity to transfer their child in the 2010–11 school year, the State Board of Education (SBE) adopted emergency regulations at its July 2010 meeting. Additionally, the SBE commenced the rulemaking process for the permanent regulations, which are now in the 45-day public comment period.
