Nonconformance Penalties

The Clean Air Act created a path for EPA to establish a mechanism for manufacturers to pay a penalty instead of meeting current emission standards. This authority is currently limited to heavy-duty highway engines and highway motorcycles, but EPA may seek to expand the authority for setting nonconformance penalties in the future. This page includes rulemaking activities related to heavy-duty highway engines.
