Rule and Implementation Information for Commercial/Industrial Solid Waste Incinerators

Announcements:
  • 12/01/14: EPA proposes reconsideration of, and requests public comment on, clean air standards for industrial boilers, and certain incinerators.  This reconsideration affects the air toxic standards that limit air pollutant emissions from large (major) industrial, commercial, and institutional boilers and process heaters and small (area) industrial, commercial, and institutional boilers; and commercial and industrial solid waste incineration (CISWI) units.
  • 02/07/12 - The EPA issued a No Action Assurance Letter to establish that we will exercise our enforcement discretion to not pursue enforcement action for violations of certain notification deadlines in the final CISWI rule. The EPA has not identified any new sources that have commenced operation. For details, please see 2011 Major Boilers and CISWI NAA Letter.
  • 01/09/12 - The U.S. District Court for the DC Circuit vacated the EPA's May 18, 2011, notice that delayed the effective date of the CISWI rule.
  • 12/23/11 - The EPA published the CISWI reconsideration proposal (40 CFR 60, subparts CCCC and DDDD, Commercial and Industrial Solid Waste Incineration Units: Reconsideration and Proposed Amendments). The EPA will accept comment on the reconsideration proposal until February 21, 2012
  • 05/18/11-The EPA published a notice today delaying the effective date of the CISWI rule until the completion of the recently announced reconsideration or the completion of litigation on the rule, whichever is earlier.
