CAIR 'Optimistic' On Jobs Settlement With Dell

WASHINGTON -(Dow Jones)- A national Islamic civil rights group was retained as legal counsel by 21 of 30 Muslim employees who were allegedly forced from a Dell Inc. (DELL) plant in Nashville, Tenn., for seeking to pray in their workplace.

In a press release Tuesday, the Council on American-Islamic Relations, or CAIR, said the workers signed retainer agreements with the council in Nashville on Saturday.

The council's Legal Affairs Director Arsalan Iftikhar said in an interview that the group is optimistic about a settlement over the Feb. 4 incident, which involved workers of Somali origin hired through a contract with the staffing company Spherion Corp. (SFN).

"I do feel that Dell as been responsive so far," Iftikhir said, adding that any settlement acceptable to the group would include reinstatement for the workers as well as back pay.

The council helped settle a similar dispute involving contract workers for Solectron Corp. (SLR) in 1999.

The Dell case is expected to be mediated through the City of Nashville's Human Relations Commission.

Last week, CAIR asked that the Muslim workers who were forced from their jobs be rehired pending resolution of the issues involved. The group also offered to mediate a mutually agreeable settlement to the dispute....

Dell Corp., through a spokesman, said the company is "confident a resolution is going to be reached" between the company and the displaced Muslim contract employees in Nashville...

The employees in question were not working for DELL directly. The Somali immigrants were employed by a staffing agency called Spherion Corp. This in and of itself should make it a non-issue. DELL can simply stop using Spherion's services.

Several Somali workers fired from a nearby Whirlpool plant lost a trial on a similar issue last September. The jury decided Whirlpool was within its rights to limit workers' break times so as not to disrupt factory production.

These men were fired for leaving their workstations. They should have told the temp agency and Dell about their religious requirements.You go to work to work, not pray.

Options:

Find another employment agency and be honest about requirements, only accept offers for employment that fit prayer schedule. Do not anticipate the employer will be accomodating.

Flex time - Assuming this 'factory' shift can accomodate a flex schedule - start shift earlier and end shift later - do not get paid for 'prayer time'

Work 3rd shift ...9pm to 6am

Bottom line . . .DELL is answerable the shareholders NOT employees whining about their religion.

It is up to the workers, one would think, who know in advance of their special requirements, not to seek employment where the work schedule will interfere with those special requirements --or more accurately, where their special requirements will interfere with the work schedule, incluidng the idling, in the middle of the work day, of large and expensive equipment, thereby disrupting other workers who do not have such "special" requirements.

Were these workers who should, at the time they were being hired, have notified Spherion of their requirmeents, so that Spherion could either make a decision on its own whether to hire them, or contact Dell about the matter. They, after all, knew that they wouled be interrupting the work day several times -- and not for a minute of silent prayer in the manner which most of us think of, but with an entire ritual of Wudu (ablutions), or at least of the prayer-rug, pointed Mecca-wards, the removal of shoes (heavy laced workboots, presumably?), and then the prayer, and the chanting (surely this must disrupt other workers), and then relacing those heavy work boots, putting away the rugs, and so on. What does it take, five times a day?

The refusal, or inability, of Muslims to understand why an entire non-Muslim nation will not accept demands for changes in everything from the workplace, to the free-speech belief that nothing should be immune to discussion, analysis, or even ridicule, or ridicule, to every single aspect of our political, economic, intellectual, and social understandings, all of which are flatly contradicted by Islam and the Sharia. This is a conflict that will not go away, and it is one where Muslims may decide that they cannot be good Muslims in an Infidel society, and they will not be able to undermine or dhimmify us, and eventually draw the conclusions that many of us hope they will draw.

Third shift is a good idea for these Somalians. Muslims need to realize that they live here because of this nation's financial successes, and that their prayer time is not important during work hours. Oops, did I just offend Allah? Yes, yes I did.

When "Allah" starts signing their damn paychecks, then they can go pray to him instead of doing their jobs. Until that time comes, they should follow the rules like everyone else.

I would suggest that these big companies who use these staffing agencies let the agencies know that production schedules need to be met, and that anyone who feels the need to pray to "Allah" needs to do it on their own time, not the company's.

Who invited the Somalians here anyway? I have Muslim friends who tell me that the Somalians give Islam embarrassment.....Remember our boys in Mogadishu 1993.

I suspect that ultimately, this will all backfire. Corporations currently availing themselves of such service providers and contract employees will start drawing up agreements that require that the contractors be prepared to work in accordance the demands of business and the contractors themselves will be required to sign agreements acknowledging what their work hours and breaks will be.

If they can stop working five times a day to pray then why can't I start kicking people down a pyramid in the back parking lot?

Damn these regulations that prevent me from communing with the higher powers and and my base desires!

I am so sick and tired of muslims expecting special arrangements to bow down to their moon rock idol. Maybe I should go apply for a job at cair and let them know that I am a Christian and then sue when I don't get the job due to discrimination.

This is only the beginning. The long-range goal is world take over. First defeat the present Muslim world, then Europe, and finally when nothing else is left, America.

No massive army will wait at off shore. Other efforts and resources will be used to chip away at American interests and American culture. The Dell incident is only tiny chip in the huge mulch pile that will result if we don't take appropriate action NOW.
