Court rejects Damra's appeal, triggering deportation process

Fawaz Damra update. From the Cleveland Plain Dealer, with thanks to the Constantinopolitan Irredentist:

A federal appeals court has upheld the conviction of Fawaz Damra, a decision that will prompt federal prosecutors to begin deportation proceedings against the imam of Ohio's largest mosque.

The 6th Circuit U.S. Court of Appeals denied all of Damra's claims in a 17-page opinion released late Tuesday. Damra, 43, of Strongsville, was convicted in June of lying on his immigration form and during an interview in 1993.

He failed to mention his work with the Palestinian Islamic Jihad, which opposes Israel's existence, and the Alkifah Refugee Center in Brooklyn, N.Y., where the imam knew other radicals. He came to the Islamic Center of Greater Cleveland in 1991.

U.S. District Judge James Gwin sentenced him to two months in prison and four months in home detention. He also stripped Damra's citizenship but told prosecutors they could not begin deportation proceedings until after the appellate ruling.

Once in federal immigration court, it could be two or three years before the Palestinian-born Damra is forced from the country....

Damra's attorneys said their client was never a member of the Islamic Jihad. They said that prosecutors' use of "affiliation" was ambiguous. His attorneys also said he never persecuted anyone.

Citing videotapes played at the trial in which Damra wailed about the need to give money to kill Jews, the unanimous three-judge panel disagreed....

The court also upheld the use of the Foreign Intelligence Surveillance Act involving secretly taped calls Damra made to Sami Al-Arian, who prosecutors say is a leader in the Islamic Jihad. The calls concerned Damra's attempts to launder money with the help of a former mosque leader, Dr. Azzam Ahmed, for Al-Arian, according to court records....

A number of imams have been arrested and convicted, and sometimes expelled, in many countries. In Italy, in France, in Great Britain, in Germany, and now in the United States. And some have fled before beiing arrested.

But that's it. One imam leaves, and another comes. And the farce continues, and the expense of monitoring the mosque continues. Why are not mosques, not only those where such unusual items (unusual for faiths other than Islam) such as explosives, false passports and I.D.s, audiocassettes on which violent Jihad is preached, and videocassettes of beheadings of Infidels have been found), but also those that have had such imams, not simply closed down? On what theory are they allowed to remain open? And what better theory, the best theory of all -- the theory of self-preservation, while the danger has not grown to the proportions it has been allowed to grow to in Western Europe -- not been offered in support of shutting every single mosque whose imam, or other officials, or premises, have been found to be involved, in one way or another, with aid, or moral support, of terrorism?

Are laws requiring such closures really beyond the legislative-drafting skills of American lawyers?

Looking for something pro bono that is worth your while? Start helping out in drafting such legislation, and agitating for its passage.

Poor, mistreated oppressed Damra... he must have been "mistranslated" or his urging to kill Jews was "taken out of context". He is "guilty of thoughtcrime" and "guilty by association" or somesuch. Those terrible racist judges!

Those that can not be saved from this fascist religion and cannot abide by the laws should be deported from the West,regardless of the fact they are accused of crimes in the home country, so they should answer for those crimes,even if they face the death penalty.
If they can not respect the laws of the country that they are in,then they cannot expect that country to protect them.

Forgive me for this long posting, but it's an interesting one. I receive e-mails from the Islamic Society of Boston and through the ISB, also from the Muslim American Society. This e-mail is a plea for supporting Sami Al-Arian. If you read the docket on these guys (http://www.flmd.uscourts.gov/al-arian/8-03-cr-00077-JSM-TBM/DocketSheet.html), there's apparently bucketloads of evidence that they knowingly raised money for suicide bombers. The MAS and possibly the ISB support these criminals?

P.S. What's in Surahs 3, 9 and 29? Al-Arian's daughter recommends reading those.

Absolutely terrific news.

Deportation is not, as some assume, the deprivation of privileged existence that they have in the West. After all, for the Belmarsh detainees, it was certainly not cushy to lose freedom while in jail in the West as opposed to freedom in their home countries.

They do not care for indefinite imprisonment, as it is trivial compared to the infinity of paradise that beckons, if they carry on the jihad.

What terrifies the islamist, is that they will not be able to continue the jihad in dar ul harb. No more opportunity to conduct jihad - Dawa even in jail. No jihad by way of hurting the kaffir economy. Jailing such people is very expensive, and then the costs of millions of pounds in never ending legal appeals, is all jihad. These people have thrown our whole system into confusion - see the confusion and division in Britain over the Belmarsh detainees- Magna Carta, Bill of Rights, all have been called into question, as the govt tries to find a way out.

The islamists care nought for our legal and judicial systems. They intend to hang us by our own constitutional rope.

That is why deportation terrifies the jihadi more then any other punishment our judiciary can reasonably deal out.
