PRC Hearing Procedures

Board of Inquiry

  • A closed administrative hearing; not a court of law.
  • Three commissioners hear testimony, deliberate, and make findings.
  • Closed to the public.

Legal Representation

Complainants and subject officers may represent themselves or bring a representative.

Procedures

  1. Complainant testifies and answers questions from the commissioners and subject officer or subject officer's representative.  The complainant is excused from the hearing after his/her testimony.
  2. Civilian witness, if any, testifies and answer questions from the commissioners, subject officer or subject officer's representative.  The witness is excused from the hearing after his/her testimony.
  3. Witness officer, if any, testifies and answer questions from the commissioners, subject officer or subject officer's representative.
  4. Subject officer testifies and answers questions from commissioners.
  5. Commissioners deliberate outside the presence of all parties.
  6. Commissioners announce findings to all parties.
  7. Written findings are sent to the complainant, subject officer, City Manager, and Chief of Police.
