1. For what reasons can a tree be removed?

The San Jose Municipal Code (Chapter 13.32, Tree Removal Controls) allows ordinance sized trees to be removed based on the following criteria:

• If the tree is dead.
  
• If the tree is found to be an Unsuitable Tree as defined by the City Council.
  
• If a tree is diseased, dying, in danger of falling, if it is causing damage to a structure, or interfering with utility services.
  
• If the location of the tree unreasonably restricts the economic development of the parcel.
  
• If removal of the tree would not significantly frustrate the purposes of Chapter 13.32 of the San Jose Municipal Code.

2. What is required for a Tree Removal Permit?

All Tree Removal Permit Applications require a completed and signed application, a description of the tree including the type, size, and condition of the tree, photographs of the tree, and a site plan showing the location of the tree on the parcel. A report describing the condition of the tree from a certified arborist may be required.

3. Is there a fee for my Tree Removal Permit?

Please refer to the Planning Fee Schedule for details regarding applicable fees.

4. Does the City require replacement trees?

Yes. Each Tree Removal Permit (for Live, Dead, or Unsuitable Trees) requires replacement trees. The City does not require that these replacement trees be of a particular species.
